Viswa Pratap Siingh & ORS v. State Of West Bengal & ANR
C.R.R. No.731 of 2013 D/L43 May 6, Bpg.
In Re: An application under Section 482 of the Code of Criminal Procedure;
Viswa Pratap Singh & Ors.
Versus
State of West Bengal & Anr.
Mr. Anwar Hossain, Ms. Debjani Sahu.
...for the State.
The present revisional application was preferred by the petitioners challenging the proceedings relating to Golabari Police Station Case No.725/2011 dated 02.12.2011 under Sections 498A/406/34 of the Indian Penal Code.
As none appears on behalf of the State, Mr. Anwar Hossain, learned advocate, who ordinarily appears on behalf of the State, is directed to represent the State in this mater. His appointment may be regularised by the concerned authorities. Having regard to the contentions advanced in the revisional application, I am of the opinion that the same relates to question of facts, which are to be adjudicated in course of trial. As such, no interference is called for.
Thus, CRR 731 of 2013 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
