second, in spite of Joynagar P.S. Case No.

of registered for investigation, there has been no progress in the case and the private respondents have been raising their construction at night hours violating the provisions of law.

Learned advocate for the private respondents disputes contentions advanced by the learned advocate for the

petitioner.

Mr.

Samanta, learned Junior Government Advocate, on the other hand, submits that the investigation relating to Joynagar P.S. Case No. 315 of 2022 is still under progress.

Having considered that investigation was set into motion in the year 2022 and, for more than two and half years the same has been progressing, at this stage, interference is required by this court.

Accordingly, it is directed that the SDPO/ASP/DSP-in-charge of Joynagar P.S.

would, in the circumstances, take over the investigation of Joynagar P.S. Case No.

315 of 2022, monitor and complete the investigation. The monitoring officer will submit a progress report each and every month to the concerned ACJM regarding the progress of the case. All steps be taken by the investigating officer to take

the investigation to its logical conclusion within a reasonable period of time.

In meantime, police authorities of Joynagr p.s. would also oversee that if any illegal construction is being pursued and/or being made out without the approval of the appropriate authorities, i.e., the Panchayat Authorities concerned, they would refer respondents to civil court for appropriate orders and would not allow any illegality to be continued.

With the aforesaid observations, WPA 8358 of 2023 is disposed of.

Pending application(s), if any, is also disposed of.
