Learned advocate appearing for the petitioner has prayed for expediting the proceedings of Rejinagar PS Case No. 111 dated 31-05-2021. Learned advocate submits that the prosecution has intended to examine 40 witnesses but till date only seven witnesses have been examined. The report so submitted by the State be kept with the record.
I find from the records that the learned Additional Sessions Judge, 3rd Fast Track Court, Berhamporre, Murshidabad is fixing two dates on each and every month for the purposes of the present case.
Having considered the fact that the accused persons are in custody and the case was initiated on 31st May, 2021, I direct the learned trial court to fix a schedule consisting of three dates once in a month on and from the month of May, 2024. Report so submitted by the State reflects that the date has been fixed on 9th May, 2024 and 10th May, 2024 for examination of P.W.8 and P.W.9.
Having considered the progress of the case, I direct that in case the prosecution intends to examine 40 witnesses then in that case the prosecution has to present a schedule so far as the formal witnesses are concerned and complete the examination of the said witnesses as early as possible.
The learned trial court apart from the fixing schedule should keep in mind that by 31st December, 2024 at least 50% i.e., 20 witnesses should be completed and would organize the schedule in such manner. The Public Prosecutor or the learned advocate for the State would cooperate with the learned trial court. No further adjournments be granted to any of the parties. It is directed that the trial of the case would continue in spite of the resolution of the local bar and the learned participating/representing advocate will not stall the proceedings because of any such resolution.
With the aforesaid observations, the present revisional application being CRR 1330 of 2024 is disposed of. Pending applications, if any, are consequently disposed of.
