Mr. Saptarshi Dutt Mr. Kajal Mukherjee Mr. Sudeepto Kumar Bapu ...for the Petitioners In this application, the petitioners have prayed for direction upon the court below for expeditious disposal of G.R. case no. 1747 of 2016, presently pending before learned Additional Chief Judicial Magistrate-II, Haldia. Being aggrieved by the inordinate delay, caused in disposal of the criminal proceeding, learned counsel for the petitioners submits that the FIR was lodged on 17th October, 2016 and the charge was framed on 11th March, 2019. However, till date, not even a single witness has been examined so far. The prosecution proposes to examine eight witnesses. Therefore, he prays for a direction upon the court below for expeditious disposal of the proceeding. Having heard learned counsel for the petitioners, it appears that the prayer made by the petitioners is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice and as such, the service of copy of application upon the opposite parties is hereby dispensed with.

Having considered the submissions made by learned counsel for the petitioners and that the prayer made by the petitioner is justified in view of long pendency of the proceeding, the instant application being CRR 1583 of 2026 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the aforesaid G.R. case no. 1747 of 2016 and to make best effort to conclude the proceeding preferably within a period of six months from the next date of hearing.

This order is passed invoking this court's jurisdiction under Section 529 of the BNSS.
