18.11.2022 Court No.13 Item No.14 AP CPAN 415 of 2022 Smt. Lasxmi Barua Vs.

Shri Subhash Adhikary and Ors.

In WPA 15941 of 2021 Smt. Lasxmi Barua and Ors.

Vs.

The State of West Bengal & Ors.

Mr. Goutam Dey Mr. Dipendu Sarkar Mr. Kaushal Kumar Ms. Ankita Ghosh ... For the Petitioner.

Mr. Amitesh Banerjee Ms. Ipsita Banerjee ... For the State.

Mr. Pulokesh Bajpayee Mr. Rivu Dutta ... For the Railways.

The railways are represented. They have clearly admitted that the land in question belongs to them. The State and the Charu Market Police obviously cannot put the petitioner back in possession of a property that does not belong to the State and belongs to the railways.

In these circumstances, the contempt application shall stand disposed of without any further order.

Rule, if any, shall stand discharged.

There will be no order as to costs.

Interim orders, if any, shall stand vacated.

All parties are to act on a server copy of this order duly downloaded from the official website of this court.
