According to the petitioners, who are the villagers of Mouza Tushkhali, under Sandeshkhali Police Station, the respondent nos. 9 to 20 have forcefully attempted to cut a portion of the embankment on the Raimangal river in order to divert the flow of water. Such attempt on the part of the respondent nos. 9 to 20 was an offence under the Bengal Amendment Act, 1982. Interference of this Court is sought for in view of the alleged inaction on the part of the police authorities. The police authorities have filed a report.

It appears that an enquiry was made. Reports were called for from the Sub-Divisional Officer, Irrigation, Kalinagar and the Block Land & Land Reforms Officer, Sandeshkhali, Block-II. An inspection

report has been forwarded to the police authorities by the Sub-Divisional Officer, Kalinagar. It was found that the embankment on the river was in good condition and there was no sign of any damage to the embankment.

Nothing further remains to be decided in this writ petition.

The police authorities shall continue with their vigil and ensure that the embankment is not damaged or cut up. Law and order will be maintained.

The police report is taken on record.

Accordingly, this writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
