The State of West Bengal and another The revisional application was preferred challenging the maintainability of the proceedings under Section 12 of the PWDV Act before the learned Judicial Magistrate, 4th Court, Alipore in A.C. 385 of 2018. The said order was passed on 11th February, 2021 and more than two years have expired in the meantime. There has been no persuasion in the proceedings of the present revisional application on behalf of the petitioner.

Having considered the stage at which the petitioner approached this Court and the reasons so assigned by the learned Judicial Magistrate passing the order dated 11.02.2021, I am of the opinion that no interference is called for.

Accordingly, CRR 1108 of 2021 is dismissed.

Pending application, if any, is consequently dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
