Kutubuddin Mr. Santanu Deb Roy ....for the State Being aggrieved by and dissatisfied with the order dated 3.9.2020 passed by the learned Chief Judicial Magistrate, north 24 parganas in C.S case no. 1004 of 2020, the present application under Section 482 has been preferred.
At the time of hearing, learned advocate appearing for the petitioner submits that learned trial court has already taken cognizance under Section 190 of the Code of Criminal Procedure. Appropriate direction may be given for taking initial deposition of the complainant's witnesses at the earliest and to conclude the hearing of the said complaint case within a time schedule. Learned advocate for the State did not raise any objection in respect of the aforesaid submission.
In view of the above, the trial court is requested to take the recourse of Section 200 of the Code at the earliest and to take next course of action in compliance with Chapter XV of the Code of Criminal Procedure and to dispose of the entire proceeding as expeditiously as possible preferably within a period of six months
from the date of communication of the order since the matter is pending long.
Accordingly, the revisional application being CRR 1104 of 2020 is disposed of.
Pending application being CRAN 3618 of 2020 is also disposed of.
Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
