The writ petitioner joined service at a belated stage on 21st August, 2004 and retired on 31st August, 2013 as Assistant Teacher under the DPSC, Howrah.

There is a fall short of 11 months 25 days in the qualifying the period of tenures of service for pension. The petitioner knew of such shortfall at the time when he entered into service.

The DCRB Rules permit the State to condone the shortfall upto six months of qualifying service for pension. In those circumstances, no relief can be granted to the petitioner.

Accordingly, the writ petition fails and the same is dismissed.

There will be no order as to costs.
