Mr. Sounak Bhattacharya Mr. Sounak Mondal ...for the Petitioners The petitioners herein have prayed for a direction upon the court below for expeditious disposal of Misc. Case No. 280 of 2018 presently pending before the learned Judicial Magistrate, Howrah.

Being aggrieved by the inordinate delay caused in disposal of the petitioner's application filed under section 12 of the Protection of Women from Domestic Violence Act, 2005, seeking relief thereby under sections 17/18/19/20/22, learned counsel for the petitioners submits that the said proceeding was initiated by the petitioner/wife way back on 4th May, 2018. Since then, about eight years have already passed but the proceeding is still pending for disposal. Accordingly, she prayed for necessary direction upon the court below for expeditious disposal of the proceeding.

Having heard learned counsel for the petitioners, it appears that the prayer made by the petitioners is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice

and as such, the service of copy of application upon the opposite parties is hereby dispensed with.

Having heard learned counsel for the petitioners and also considering the fact that the proceeding is kept pending for more than eight years, I find that the prayer made by the petitioners is justified and is required to be allowed for securing the ends of justice.

In view of the above, the instant application being CRR 1628 of 2026 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the Misc. Case No. 280 of 2018 and to make its best effort to conclude the entire proceeding including disposal of interlocutory applications preferably within a period of six months from the next date of order, without granting any unnecessary adjournments to either of the parties.

Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
