1. The petitioner seeks compassionate employment on account of his father with the DPSC, South 24 Parganas. His father served from November, 1999 till January, 2014, when he died. The petitioner's mother made an application for compassionate employment on 22nd May, 2014. She may not have been qualified or may have changed her mind in 2018 when the petitioner applied for compassionate employment.

2. The application of the petitioner appears to have been forwarded by the D.I. of Schools until the year 2018 to the Chairman, DPSC, South 24 Parganas.

3. While the petitioner's application is beyond the period of two years after the death of his father, his mother's application for compassionate employment became infructuous after the writ petitioner's application.

4. Having regard to the facts and circumstances, this Court even otherwise finds that the immediacy of the financial stringency or the likelihood of starvation or want of money cannot exist as on date after ten years of the death of the employees. The application for compassionate employment has, even otherwise, become infructuous by efflux of time.

5. In those circumstances, the writ petition shall stand dismissed. Interim orders, if any, shall stand vacated.

6. There will be no order as to costs.

7. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
