This is an application for quashing the charge-sheet and FIR in respect of criminal proceeding initiated vide Uluberia P.A. Case No.565/16 dated 12.9.2016 under Sections 341`/195A/354B/325/506/34 of the Indian Penal Code. The matter heard at length on behalf of the petitioner as well as the State.
Learned advocate appearing on behalf of the State produced the Case Diary.
On perusing the materials i place before me, it appears to me that the petitioner has good grounds to raise the issue, which was raised before this Court at the appropriate time of framing of charge. Considering the said aspect, it appears to me that the pendency of the criminal revisional application is not necessary. Accordingly, the instant criminal revisional application is disposed of with a specific direction
that this Court has not looked into the merit of the matter in question. It is placed before the learned Court below for its usual consideration on the basis of the principles laid down in the law.
Accordingly, the instant criminal revisional application is disposed of.
