The allegation against the petitioner is under Sections 302/34 of the Penal Code. The petitioner is in custody for 295 days. It is submitted on behalf of the petitioner that charge-sheet has been submitted. He has been falsely implicated. His further detention is not necessary.
The State opposes the prayer for bail and refers to statements of neighbours recorded under Section 161 of the Code of Criminal Procedure. We have considered the material in the Case Diary. It prima facie appears that the petitioner is the principal accused who stabbed the victim with a knife. The offending knife has been recovered from the petitioner. Having considered the material in the Case Diary and prima facie involvement of the petitioner in the alleged offence, though charge-sheet has been submitted, and in view of the gravity of the offence, we are not inclined in granting bail to the petitioner at this stage.
The application for bail being CRM 3259 of 2021 is, thus, dismissed.
