Re: I.A. No. CAN 1 of 2023 The petitioner seeks recalling of the order dated 28th April, 2023 dismissing the writ petition for default.

I have perused the said application and being satisfied with the reasons mentioned therein, recall the order dated 28th April, 2023 I.A No. CAN 1 of 2023 is disposed of.

The writ petition is restored to its original file and number.

Re: W.P.A. 8003 of 2022 The petitioner seeks consideration and disposal of the representation which has been pending consideration before the Municipality. Without entering into the merit of the said representation the writ petition is disposed of by

directing the Rajpur Sonarpur Municipality to take a decision on the said representation in accordance with law after giving reasonable opportunity of hearing to the petitioner and to pass a reasoned order and communicate the same to the petitioner immediately thereafter. It will be open for the Municipality to cause a spot inspection to ascertain the grievance putforth by the petitioner in the representation upon prior notice to the petitioner.

The petitioner is directed to forward a copy of the representation to the aforesaid respondent at the time of communication of this order.

The decision shall be taken in the matter at the earliest but positively within a period of twelve weeks from the date of communication of this order.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
