Case No. 1 of 2025 arising out of Patiram Police Station Case No. 3 of 2025 dated 01.01.2025 under Section 21(c)/22(c)/23(c)/27A of the NDPS Act, 1985.

And In re: Imran Hossain Mondal ... petitioner Mr. Kaushik Chowdhury ...for the petitioner Mr. Soumik Ganguly Mr. Soumadip Saha ...for the State Prosecution alleged that huge quantity of narcotic substance was recovered from the co-accuse Aloke Mondal. Learned Counsel appearing on behalf of the petitioner submits that no seizure was made from the possession of the present petitioner and he is in custody for about 178 days and he has no criminal antecedence and that investigation has already been ended in charge sheet and as such he may be released on bail on any terms and conditions.

Learned Counsel appearing on behalf of the State submits that during investigation it reveals that petitioner has direct nexus with the driver of the vehicle wherefrom contraband substance was seizedand he made repeated phone calls with the driver and other co-accused and which prima facie transpired his complicity with the alleged offence and as such he opposed the bail prayer. I have considered the submissions made on behalf of the petitioner and the State and in view of the materials placed before this Court including the materials available in the Case Diary, it appears that rigour of Section 37 of the NDPS Act attracts in the present case in respect of the present petitioner and as such the prayer for bail is

considered and rejected.

The application, being CRM (NDPS) 454 of 2025 is accordingly disposed of.
