The petitioner is aggrieved that the private respondent has effected construction on the public land and on a part of his land. He complains that this construction is preventing ingress and egress to his property.

The petitioner has lodged a complaint with the Dholahat Police Station under Sundarban Police District and cries of inaction.

The instructions of Dholahat Police Station under Sundarban Police District addressed to the Government Pleader, High Court, Calcutta dated 9th May, 2022 filed in Court today, be taken on record. It appears from the said instructions that proceedings under Sections 107 and 116 of the Code

of Criminal Procedure have been drawn up.

In those circumstances, Inspector-in-charge, Dholahat Police Station under Sundarban Police District shall ensure that there is no breach of peace in the area. Any other reliefs that the petitioner may seek against the private respondent for any illegal construction on his land or public land may be agitated before an appropriate forum.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
