Banerjee) Mr. Tarak Nath Halder ... for the petitioners This application under Article 227 of the Constitution of India is at the instance of the decreeholders praying for a direction upon the learned Civil Judge (Jr. Division), Bidhannagar to dispose of Misc. Case No. 59 of 2013 expeditiously.
Mr. Halder, learned advocate appearing for the petitioners draws the attention of the court to the order dated March 6, 2021 in support of his contention that the misc. case was fixed for argument on March 20, 2021.
In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite parties or upon the learned advocate representing the opposite parties before the learned trial judge.
From the order-sheets appended to this application this court finds that an application for substitution is pending.
Mr. Halder, learned advocate appearing for the petitioners submits that August 2, 2025 has been fixed for hearing of such application.
In the light of the submissions made by the learned advocate appearing for the petitioners, CO 1283 of 2025 stands disposed of by requesting the learned Civil Judge (Jr. Division), Bidhannagar to dispose of the application for substitution expeditiously and thereafter to make an endeavour to see that the Misc. Case No. 59 of 2013 is disposed of as expeditiously as possible without granting any unnecessary adjournment to either of the parties keeping in mind that the misc. case is pending since 2013.
The learned executing court is requested to dispose of the misc. case within a period of six months from the next date fixed in the misc. case, if the same is otherwise ready.
