In this application the petitioners have prayed for quashing of the proceeding being GR Case No. 3196/2025 pending in the court of learned Chief Judicial Magistrate, Barasat.

It appears that the same petitioners initially filed one revisional application being CRR 4562 of 2025 for quashing of the proceeding and in that application it was also prayed that appropriate direction be issued upon the Investigating Officer not to take any coercive action without serving any notice under section 35(3) of the BNSS, 2023. Upon hearing, this High Court by an order dated 18.11.2025 directed the investigating Officer to proceed in accordance with law only after service of notice under section 35(3) of the BNSS, 2023.

It is submitted that the investigation is still continuing.

In such view of the matter and in view of the order passed by this Court dated 18.11.2025, I find no further direction is required to be passed in connection with

impugned proceeding and therefore, the instant application being CRR 1590 of 2026 thus stands dismissed. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
