Halder Mr. Indranil Halder ...for the petitioner This application under Article of the Constitution of India is at the instance of the wife praying for a direction to the learned Additional District Judge, 8th Court at Alipore to dispose of matrimonial suit expeditiously.

The learned advocate appearing for the petitioner submits that the petitioner is receiving the threats from the opposite party herein and for such reason the instant application for expeditious disposal has been filed.

After going through the order sheets appended to this application, this Court finds that an application under Section 27 of the Special Marriage Act has been filed only on January 13, 2025. It appears that the records, that the suit was transferred from the Court of the learned District Judge, South 24-Parganas to the Court of the learned Additional District Judge, 8th Court at Alipore. The learned Additional District Judge, 8th Court at Alipore by an order being No.3 dated February

27, 2025 directed the petitioner to take steps upon the respondent and fixed June 20, 2025 for steps. No material has been placed before this Court to show that the summons of the suit has been duly served upon the opposite party herein. Considering the stage of the suit and also taking note of the fact that the same was filed only in the month of January, 2025. This Court is not inclined to pass any direction for expeditious hearing at this stage.

With the above observations CO 1284 of 2025 stands disposed of.

It will be open to the petitioner to avail of the recourses available in law if the petitioner is being threatened by the opposite party.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
