Petitioner Mr. Shataroop Purkayastha ...For the Petitioner This is an application for expeditious trial of A.C. Case No. 1460 of 2018 under Section 138 of the Negotiable Instruments Act, 1881, pending before the Learned Judicial Magistrate, 8th Court, Alipore. It has been submitted by the learned advocate for the petitioner that though the case was instituted in May 2018, till date, the plea has not been recorded. Due to the pandemic situation, delay in conclusion of the said trial cannot be attributed to the learned Magistrate in the court below.

This revisional application being CRR 1111 of 2021, is disposed of with a direction upon the learned Magistrate in the Court below to conclude the trial as early as possible, preferably within a period of one year from date of the resumption of normal functioning of the Court without granting unnecessary adjournment to either of the parties.
