WPA 8429 of 2025 (Sajal Das vs. State of West Bengal & Ors.) Mr. Debarshi Brahma Mr. Subarna Bank .... For the Petitioner Mr. Raja Ram Banerjee .... For the State Report submitted by the State is taken on record. On the basis of work order issued in favour of the petitioner on 5th July, 2019 for construction of ICDS centre at Ganakkata Primary School in Bandhgora Gram Panchayat, the petitioner completed the entire construction work on 12th January, 2021. The credential certificate was issued in his favour on 9th January, 2024. Out of the entire due amount of Rs.7,98,950/- Rs.4,50,000/- was paid to the petitioner. The remaining of Rs.3,48,950/- is still due. Though the authority assured payment of such amount upon receipt of allotment, the same plea is being taken by the authority till date.

Several representations submitted by the petitioner before the authority in this regard have fallen on deaf ears. The petitioner seeks clearance of the due amount. In view of the fact that the petitioner has completed the work allotted in his favour on 12th January, 2021 and has been granted credential certificate for the same by the authority, the Executive Officer, Jhargram Panchayat Samiti being the 8th respondent herein, is directed to disburse the due amount of Rs.3,48,950/- in favour of the petitioner within 8 weeks from the date of communication of this order. The writ petition is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
