The State of West Bengal

1. The parties are not represented even on the second call nor any accommodation is prayed for on behalf of the parties.

2. The appeal is pending since 2002. The appeal was appearing in the warning list of cases on and from 19th July, 2023 with a clear indication that the said matter shall be transferred to the Regular Bench on and from 1st August, 2023. All the parties have sufficient notice about the listing of the matter before the Regular Bench on and from 1st August, 2023. In spite of notice, the parties are not represented. It thus shows that the parties are not interested to proceed with the appeal.

3. Under such circumstances, the appeal is dismissed for default.
