Wasim Akram ... for the Petitioner(s) Mr. Arijit Ganguly Ms. Rita Datta ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for 250 days and is similarly situated as the other accused person who has been granted bail. It has also been contended that there has been no quantification in the chemical examiner's report, as such, the petitioner may be enlarged on bail as he is unnecessarily languishing in jail.

Learned advocate for the State opposes the prayer for bail and submits that the seizure list reflects that from the exclusive possession of the present petitioner, the recovery of the contraband was made.

Having regard to the fact that two contraband reflecting in the chemical examiner's report, namely, Diacetylmorphine (Heroin) and 6-Monoacetylmorphine, I am

of the opinion that, at this stage, this will not be a fit case to release the petitioner on bail.

Hence, the prayer for bail of the petitioner is Rejected.

The petitioner be better advised to approach this court after the evidence of the seizure list witnesses is over. Accordingly, CRM (NDPS) 683 of 2026 is Dismissed. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
