By this writ petition, petitioner has challenged the impugned adjudication order dated 30th December, 2023, which is an appellable order under the WBGST Act, and petitioner without availing the alternative remedy of statutory appeal intends to invoke the constitutional writ jurisdiction of this Court which I am not inclined to invoke in view of the fact that the impugned order has been passed after giving opportunity of personal hearing to the petitioner and that the order is the speaking order based on material facts and evidence which cannot be re-appreciated or scrutinized by the writ court as an appellate authority and further the impugned order is not contrary to any

specific provision of law nor the impugned order has been passed by committing any procedural irregularity and in view of these facts, I am not inclined to grant any relief to the petitioner except granting extension of time by two weeks from date to file statutory appeal and all the points raised in this writ petition is kept open before the appellate authority.

With this observation and direction, this writ petition being WPA 9119 of 2024 is disposed of. ( Md. Nizamuddin, J.)
