Heard learned counsels for the parties.

Learned counsel for the petitioner submits that the petitioner was awarded maintenance by the learned Judicial Magistrate, 1st Court, Jangipur. Since the private respondent failed to pay such maintenance regularly the petitioner filed an execution case before the learned Magistrate and warrant of arrest was issued against the private respondent. The petitioner alleges that the private respondent has not been arrested in execution of the warrant of arrest till date.

It appears from the report submitted by the State that despite several attempts made by the police, the private respondent could not be arrested.

The petitioner is at liberty to take necessary steps before the learned jurisdictional Magistrate in this regard.

Since nothing further remains to be adjudicated in this writ petition, the same is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
