Learned advocate appearing for the petitioner submits that he complained to the Officer-in-Charge, Burabazar Police Station in respect of the private respondents for storage of inflammable materials. Mr.

Banerjee, learned Senior Standing Counsel appearing on behalf of the state submits that police authorities informed the Fire Department, inspection was carried out by the Fire Department and no complaint was made by the Fire Department. As such police authorities did not have the authority to register any case as complained of presumably because of the fact that hardly any inflammable materials were available during the inspection by the Fire Department.

In view of the contentions advanced by the petitioner regarding encroachment of the stair case

and expiry of the lease, petitioner would be at liberty to approach the jurisdictional civil court which will consider the same in accordance with law.

For the time being, I find that the petitioner and the private respondents are at loggerhead. As such police authorities would keep a strict vigil and ensure that no untoward incident takes place because of the inimical relationship between the petitioner and the private respondents.

With the aforesaid observations WPA 9292 of 2024 is disposed of.
