The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite party, as such, service of notice of the present application upon the said opposite parties is dispensed with.

The petitioners have applied for setting aside of the preliminary decree dated November 13, 1991 passed on compromise in a partition suit being Title Suit No.53 of 1991 by the learned Civil Judge (Senior Division), Purba Bardhaman. The said application has been registered as Misc. Case No.53 of 2019. The petitioners are complaining delay in disposal of the said Misc. case and are praying a direction for expeditious disposal of it.

It appears that the said misc. case has reached to the stage of peremptory hearing; witness action is going on. The learned Trial Judge is therefore requested to make all endeavour to dispose of the said application, if it is otherwise ready for such disposal as expeditiously as possible in accordance with law and in doing so, shall not entertain the prayer of the parties for any unnecessary adjournment.

C.O. 1144 of 2024 is disposed of with the above terms without any order as to costs.
