Amicus Learned counsel for the petitioner submits that the petitioner is the mother of the 16 year old victim girl. It is alleged that the petitioner had developed a relationship with the private tutor of the victim girl. She allegedly did not take any steps when the principal accused started sexually abusing the minor victim. The principal accused is still in custody.
Learned counsel for the de facto complainant strongly opposes the prayer for anticipatory bail.
Learned Amicus, assisting the State, relies on the case diary and opposes the prayer for anticipatory bail. He also relies on the statement of the victim girl made before the police and the learned Magistrate and the statements of
witnesses including that of the grandmother of the minor victim. According to her, when they raised the issue of molestation by the private tutor upon the victim, the petitioner abused them and avoided the issue to be raised. It also appears that on a particular occasion, the petitioner went to Digha with the tutor and the minor victim. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
