The present revisional application was preferred challenging the proceedings relating to C.R. Case No. 103 of 2015 under Sections 420/506/34 of the Indian Penal Code. The petitioners approached this Court at a stage prior to consideration of charges by the learned Magistrate. Having considered the issues so involved, I am of the opinion that the complainant must be granted an opportunity of adducing evidence before the jurisdictional court to prima facie satisfy the trial court as to whether from the evidence so adduced, a case for continuation after charge is made out. No interference is called for at this stage.

With the aforesaid observations, the revisional application being CRR 1261 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
