Learned advocate appearing for the petitioner submits, petitioner is in custody for more than 2 years and 1 month and submits that the prosecution has not complied with the earlier directions passed by this Court while rejecting the bail. Learned advocate for the State opposes the prayer for bail and submits that in respect of another accused, 5 months time has been granted for completing the trial. The subject matter of the case involves recovery of 7500 bottles of Phensedyl.

According to the State, the last witness being the Investigating Officer of the case is being examined. Next date has been fixed on 1st June, 2026.

Having considered the advanced stage of the case, I am not inclined to grant bail to the petitioner. However, the learned Special Court would see that if no defence witness is tendered, then after examination under Section 313 of the Code of Criminal Procedure within the time period prescribed in CRM (NDPS) 495 of 2026, the verdict be pronounced. Accordingly, CRM (NDPS) 769 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
