Affidavit of service filed in Court is taken on record.

The petitioner complains of alleged inaction on the part of the Chatterjeehat Police Station in dealing with the private respondents. The petitioner seeks protection against assault and restraint order on cars being parked inside the premises.

The multi-storey building has been found to be constructed in violation of sanctioned plan by the Howrah Municipal Corporation and an

order of demolition dated 8th July, 2022 has been issued.

The occupants of the authorised and unauthorised portions of the building are represented. On their part, the Police have investigated into eight several FIRs and have filed charge sheets. There is one FIR No. 61 of dated 8th April, pending investigation.

Four several proceedings under Sections 107/116 of the Cr. P. C. have been drawn up by the Chatterjeehat Police Station.

The investigation into the pending FIR No.

61 of 2023 dated 08.04.2023 shall be completed by the Police within two months from date.

This Court finds no inaction in the part of the police.

8.

The Police shall ensure that there is no breach of peace in the area. Any order and/or direction and/or request that may be passed by the Howrah Municipal Corporation, shall be strictly complied with by the Chatterjeehat Police Station.

9.

The writ petition is disposed of.

10.

There will be no order as to costs.

11.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
