Heard & Judgement on :- 27.09.2022 BIBEK CHAUDHURI, J. : - Affidavit of service be kept with the record. In the instant revision, the petitioner /accused has prayed for quashing of G.R. Case No.1847 of 2022 arising out of Jaynagar Police Station Case No.239 dated 30th March, 2022 under Sections 447/341/323/325/307/354/427/506/34 of the Indian Penal Code. The petitioner appears in person.
I have heard the petitioner.
This Court is of the view that the instant revision can be disposed of here and now with the assistance of the learned advocates on behalf of the State. Therefore, Mr. Swapan Banerjee with Ms. Baishali Basu, learned advocates are requested to assist this Court in the instant revision.
The petitioner is directed to serve a copy of the revisional application and the supplementary affidavit to the learned P.P.-in-charge. The petitioner has filed a supplementary affidavit annexing the charge sheet filed against him. It appears from the copy of the charge sheet that on conclusion of investigation police submitted charge sheet against the petitioner under Sections 447/341/323/354/506/34 of the Indian Penal Code.
On careful perusal of the supplementary affidavit it is submitted by Mr. Banerjee, learned P.P.-in-charge that there is no ground whatsoever where the Court should quash the charge sheet filed against the petitioner. The instant revision can be disposed of directing the learned Additional Chief Judicial Magistrate, Baruipur to expedite the trial of the case.
The instant revision is accordingly disposed of directing the Additional Chief Judicial Magistrate, Baruipur to supply the copy of the charge sheet and other documents under Section 173(5) of the Code of Criminal Procedure to the accused /petitioner within seven days after reopening of the Court.
The learned Additional Chief Judicial Magistrate, Baruipur is requested to conclude the trial of the case within six months from the date of supply of the copy positively.
With the above order, the instant revision is disposed of. (Bibek Chaudhuri, J.)
