Civil Revisional Jurisdiction Subrata Bhattacharyya AR(C) CO No.1293 of 2025 Jetinder Singh Sareen -vsJagdeep Kumar Sareen Mr. Debangshu Dinda Ms. Dibyanjona Das ...for the petitioner This is an application under Article 227 of the Constitution of India at the instance of the husband praying for a direction upon the learned Additional District Judge, Fast Track Court, 2nd Court at Barasat to dispose of Matrimonial Suit No.2748 of 2021 renumbered as Matrimonial Suit No.285 of 2021 expeditiously. Learned advocate for the petitioner submits that an application under Order VI Rule 17 of the Code of Civil Procedure, 1908 for amendment of plaint was allowed and that the opposite party herein has not filed any additional written statement.

It is further submitted that no order directing payment of any alimony has been passed in the said suit. In view of the order sought and proposed to be passed, there is no necessity to direct the petitioner to serve notice upon the opposite party. However, learned advocate for the petitioner shall be obliged to serve a copy of this revisional application along with this order upon the opposite party or upon the learned advocate representing the opposite before the trial judge.

In the light of the submission made by learned

advocate for the petitioner, CO No.1293 of 2025 is disposed of by requesting the learned Additional District Judge, Fast Track 2nd Court at Barasat to make an endeavour to see that Matrimonial Suit No.285 of 2021 is disposed of expeditiously, without granting any unnecessary adjournment to either of the parties, provided the petitioner/husband is not a defaulter of any payment of maintenance or alimony.

Certified copy of this order, if applied for, shall be given to the parties.
