Mr. Binay Kumar Panda along with Mr. Narayan Prasad Agarwal , learned Advocates who usually appear on behalf of the State are requested to appear in this revisional application. Learned Public Prosecutor is requested to regularize the appointment of Mr. Binay Kumar Panda and Mr. Narayan Prasad Agarwal learned advocates in due course.

Learned Advocate on behalf of the State appears and submits that this revisional application is pending since 2011 whereby initially the proceedings pending before the learned court was stayed for three weeks in the month of January, 2012.

From the record, it appears that stay was not extended after January, 2012. This revisional application under Section 401 read with Section 482 of the Code of Criminal Procedure was filed challenging the order of taking cognizance by the learned Additional Chief Judicial Magistrate, Alipore 24-Pargnass (South) and also order of issuing process.

After careful perusal of the order impugned along with the revisional application, I do not find any reason to interfere with this revisional application.

Thus, being the position, the revision application stands dismissed.

The learned Registrar (Judicial Services) is requested to communicate this order to the learned Additional Chief Judicial Magistrate, Alipore, 24-Pargnass (South) forthwith. (Bibhas Ranjan De, J. )
