Mr. Santanu Talukdar Ms. Roma Roy .....For the Petitioner Petitioner is aggrieved by the factum that he has been ordered to pay maintenance of Rs.10,000/- per month as per the order of the learned Additional Chief Judicial Magistrate, Kalyani, Nadia in its order dated 17.12.2022.

Learned advocate submits that before the civil court in the alimony proceedings, the petitioner is paying a sum of Rs.4,000/-. Petitioner would bring the said materials before the learned Magistrate by way of an application under Section 127 of the Code of Criminal Procedure. Learned Magistrate would consider the same in the background of the judgment of the Hon'ble Supreme Court in the case of Rajnesh Vs. Neha.

With the above observations, C.R.R. 1267 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All parties are directed to act on the server copy of this order downloaded from the official website of this Hon'ble Court. (Tirthankar Ghosh, J.)
