The petitioner has filed the instant application for bail under Section 439 of the Code of Criminal Procedure after being arrested in connection with Tehatta Police Station Case No. 18 of 2021, dated 11.01.2021under Section 376(3) of the Indian Penal Code and Section 4 of the POCSO Act.

The petitioner is languishing in jail in connection with the aforementioned case and has applied for bail. It is submitted that the petitioner has been falsely implicated in this case having no complicity to the alleged offence.

After perusing the statement of the minor victim girl who is 13 years of age and the medical examination report annexed to the Case Diary, we do not think that it is a fit case where the petitioner should be enlarged on bail.

Accordingly, the prayer for bail of the petitioner is rejected. The application for bail, being CRM 3285 of 2021, is thus dismissed.
