CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 1212 of 2012 In the matter of : Sunil Gorai .....petitioner. In Re : An application under Section 401 read with Section 482 of the Code of Criminal Procedure.

The revisional application was preferred against the order of acquittal passed in Criminal Appeal No. 28 of 2011 in respect of a complaint case which was filed in the year 2005.

Having regard to the fact that more than 9 years have been passed in the meantime, I am not inclined to interfere with the order of acquittal which was based on the factum that in respect of the self same dispute of the cheque further proceedings were also pending and the cheque was issued by way of collateral security.

Accordingly, the revisional application being CRR 1212 of 2012 is dismissed.

All pending applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.
