Mr. Pinaki Ranjan Chakraborti ....for the petitioners The learned advocate appearing for the petitioners submits that the petitioner no.3, namely, Jahiruddin Sk. passed away during the pendency of the writ petition and no steps for substitution of such petitioner has been taken by the other writ petitioners or by the heirs of the said deceased petitioner. He further submits that remaining petitioners have given a written instruction to him to withdraw this writ petition as the petitioners do not want to proceed with this writ petition any further. An undated written instruction given by the five (5) petitioners to their learned advocate and the death certificate of the petitioner no.3 filed by the learned advocate for the petitioner are taken on record. In the light of the submission made by the learned advocate for the petitioners, the writ petition stands dismissed as withdrawn.

There will be no order as to costs.
