It appears that an undertaking is filed before the Executing Court instead of filing before this Court. Mr. Haradhan Banerjee, learned Advocate for the appellant, submits that there was a miscommunication amongst the learned Advocate-on-Record of the instant appeal and the learned Advocate-on-Record appearing before the Executing Court and prays for an extension of time to file affidavit of undertaking in terms of the order dated 24th August 2023.

In view of the above, time to file undertaking is extended till 5th September 2023.

Let the matter be listed on 6th September 2023. The photocopy of the undertaking filed before the Executing Court is kept on record.
