The application is disposed of by taking up the writ petition for consideration.

The petitioner seeks sanctioning and release of lifetime arrear pension payable to the husband of the petitioner as well as family pension.

Learned advocate appearing for the petitioner draws the attention of the court to the writing dated March 3, 2020, issued by the Commissioner of School Education, West Bengal. He submits that by such writing, the Commissioner of School Education observed that the petitioner is at liberty to approach the Director, Pension Provident Fund and Group Insurance, West Bengal. He submits that necessary direction may be issued on such authority to finalise the issue.

State and Director, Pension Provident Fund and Group Insurance, West Bengal are represented. In the facts of the present case, in my opinion, interest of the petitioner would be subserved by permitting the petitioner to make a representation before the Director, Pension Provident Fund and Group Insurance, West Bengal. Upon such representation being made, the Director, Pension Provident Fund and Group Insurance, West Bengal will decide the representation, in accordance with law, after affording a reasonable opportunity of hearing to the petitioner. He is at liberty to hear such other persons and consult such documents that he deems appropriate. He will pass a reasoned order which he will communicate to the petitioner within six weeks from the date of receipt of the representation.

WPA 6290 of 2020 (Old No. WP 6290(W) of 2020) is disposed of.
