Paragraph 21 of the writ petition is quoted hereinbelow:

"It is admitted fact that the purported construction erected by the private respondents is an illegal construction as there is no sanction plan authorizing the private respondents to erect the construction as shown in the photographs being ANNEXURE-"P4"

herein."

Ms. Maity, learned counsel appearing for respondent nos. 6 to 8 has produced relevant sanctioned plan granted by the Municipality on 27.03.2023. She submits that the building has been constructed strictly in accordance with sanctioned plan.

In that view of the matter, there is no scope to pass any order in this writ petition.

WPA 9175 of 2024 is accordingly dismissed.

Urgent certified photostat copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Kausik Chanda, J.)
