Learned advocate appearing for the petitioner submits that the subject-matter of the case relates to alleged recovery of 240 bottles of Wincerex Cough Syrup and the petitioner is in custody for 141 days. It has been submitted that the person from whom recovery has been effected has been granted statutory bail. Charge-sheet has already been submitted. As such, further detention of the petitioner is unwarranted.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that petitioner was absconding for a considerable period of time and has been arrested on the basis of execution of the warrant of arrest.

I have taken into account the factum that there has been no recovery so far as the present petitioner is

concerned and petitioner has been implicated on the basis of statement of co-accused. Having regard to the same, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner viz., Samrat Mondal shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act, Nadia at Krishnagar.

If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of Nadia without prior permission of the learned Special Court. Additionally, the petitioner shall once in every ten days meet with the Officer-in-Charge/Inspector-in-Charge of Haringhata Police Station.

The application for bail, being CRM (NDPS) 694 of 2026, is, thus, disposed of.
