Learned Advocate appearing on behalf of the Pradhan draws the attention of the Court to the fact that, the private respondent made construction on a plot of land belonging to the private respondent and that, there was no unauthorized construction. He submits that, there is a suit pending between the private parties and that, such fact was suppressed in the writ petition.

State and the petitioner are represented.
