There has also been alleged recovery of 18.27 lakh of cash money from the house of one of the accused persons (apart from the petitioners).
Learned advocate also submits that chemical examiner's report reflects 6-Monoacetylmorphine & Morphine, which have not been quantified.
Learned advocate for the State opposes the prayer for bail since recovery was made from the present petitioners; charge-sheet has been submitted and the prosecution has relied upon 11 witnesses in order to prove its case.
Considering that the chemical examiner's report do not reflect any quantification and there are presence of 6Monoacetylmorphine & Morphine which are not quantified, I am of the view that the judgment of the Hon'ble Apex Court [Sentu Seikh v. State of West Bengal [SLP (Crl.) No. 13987 of 2025] would be applicable to the present case. The further fact that the prosecution has relied upon 11 witnesses and charges are yet to be framed.
Having considered the same and the period of detention of the present petitioner as also the fact that some time will be required to take the trial to its logical conclusion, I am of the view that further detention of the present petitioners is unwarranted.
Hence, the prayer for bail of the petitioners is Allowed.
Accordingly, the petitioner viz, Shridam Mandal @ Sidham, Ajit Mandal and Anil Mandal shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only) each, with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Judge, Special Court, 4th Court Under NDPS Act, Malda.
If on bail, the petitioners shall also make themselves physically available on each and every date so fixed by the learned Special Court/trial court and shall not leave the
district of Malda without prior intimation to the learned Special Court/trial court.
Accordingly, CRM (NDPS) 696 of 2026 is allowed. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
