Pursuant to the orders of Court, WBSEDCL had filed a Report, in which it is unequivocally stated that after completion of a field enquiry the incident had occurred due to unauthorized interference and handling of electrical installation by the deceased without any supervision and without adherence to the mandatory safety protocol. In brief, the deceased was attempting to pilfer electricity.

In such circumstances, the pendency of this writ petition will not serve any purpose. By the order dated 18th May, 2026, the petitioner was directed to take instructions in the matter. It is submitted on behalf of the petitioner that notwithstanding a

categorical direction dated 18th May, 2026, the petitioner has been unable to take any instructions. There is no legal right which the petitioner has been able to establish and there is an absence of any prima facie case which warrants any further consideration of the alleged grievance of the petitioner.

The Report filed on behalf of the WBSEDCL is categorical to the extent that the petitioner was unauthorizedly and illegally trying to interfere with the handling of electrical installation which belongs to the WBSEDCL. These facts do not even warrant referring the matter for consideration to the authorities. With the above observations, WPA 8931 of 2026 stands dismissed.

However, there shall be no order as to costs. (Ravi Krishan Kapur, J.)
