The report filed by the S.I. Amdanaga Police Station, Barasat P. D. dated 21.07.2023 through the learned Additional District & Sessions Judge, Fast Track 3rd Court, Barasat, North 24 Parganas stated that the opposite party No. 2 has expired on 03.04.2019 supported by a copy of the death certificate. Let the said report be kept on record.

The instant revisional application was filed being aggrieved by the order of conviction and sentence passed by the learned Additional District & Sessions Judge, Fast Track 3rd Court, Barasat, North 24 Parganas whereby the opposite party No. 2 was sentenced to suffer R.I. for a period of three years and also to pay a fine of Rs. 5000/- i.d. to suffer for another two months. The opposite party No.2 was convicted under Section 304, Part-II of the Indian Penal Code. Under the facts and such circumstances of the case and the death of the opposite party No.2, nothing remains to be adjudicated. Accordingly, the instant criminal revisional application is dismissed.
