Kausik (Partly Allowed) CRM (M) 928 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Sonarpur Police Station Case No. 1550 of 2025 dated 23.10.2025 under sections 126(2)/115(2)/74/103/351(2)/3(5) of BNS, 2023. Learned advocate appearing for the petitioners submits petitioners are in custody for 253 days and charge sheet has already been submitted. Case has been committed to the Court of Sessions. Charges have been framed and witness action is about to commence.

Learned advocate for the State opposes the prayer for bail, draws the attention of the Court to the post-mortem report, seizure list as well as the statement of the witnesses. I have taken into account the complicity of the petitioner no. 1 as well as that of the petitioner no. 2. Having considered that the petitioner no. 2 is a lady and her role was restricted to aiding the petitioner no. 1, I am inclined to release

the petitioner no. 2 on bail. So far as the petitioner no. 1 is concerned, his prayer for bail, at this stage is rejected. Accordingly, petitioner no. 2, namely Rekha Saha, shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned ACJM, Baruipur, South 24 Parganas.

If on bail, the petitioner no. 2 shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of 24 Parganas, South without the prior permission of the learned Trial Court.

Accordingly, CRM (M) 928 of 2026 is partly allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
