Despite service no one represents the Beldanga Municipality.

A second proof of service is retained with the records.

By an order dated May 1, 2023, this Court directed a fresh service on the answering respondent nos. 3 to 9/Beldanga Municipality to be effected, since no one represented the said municipality in Court that day.

Pursuant to the direction of this Court a fresh service has been effected.

It is the grievance of the petitioner that pursuant to the notice dated November 5, 2018 the petitioner applied for appointment to the post of Mazdoor S. C. (Exempted Category). It is a permanent post under Beldanga Municipality. From the notice dated November 5, 2018 the petitioner submitted his application form and appeared for written

examination on February 3, 2019. The petitioner was called for viva-voce on August 21, 2019. There is no communication from the end of the municipality after that. The petitioner's representation dated February 15, 2023 has not been responded to.

Considering the fact that no one represents the municipality today in Court and also considering the submission made on behalf of the petitioner, this Court finds that justice will be sub-served by directing the respondent no.6, the Chairman, Selection Committee, Beldanga Municipality, Murshidabad or any other appropriate authority to consider the representation of the petitioner dated February 15, 2023 within a period of 8 weeks from date. A reasoned order will be passed and communicated to the petitioner within 2 weeks of passing of the same. With the directions aforesaid, WPA 8476 of 2023 is disposed of.

Since no affidavits have been directed to be exchanged in the writ petition, the allegations contained therein are deemed not to have been admitted.

All parties shall act on the server copies of this order duly downloaded from the official website of this Hon'ble Court.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance of all necessary formalities.
