This revisional application has been filed by the defendants/petitioners praying for expeditious disposal of Title Appeal No.134 of 2019, pending before the learned Additional District Judge, 1st Court, Alipore. It is submitted that the appeal could not be taken up as the same was adjourned on several dates on the prayer of the opposite party for extension of time to file the written objection in response to the appeal in question. Having considered the records, this Court is of the view that justice would be sub-served if the learned court is directed to dispose of the title appeal within a period of one year from the next date fixed upon allowing one last chance to the opposite party to file her written objection. This Court has not gone into the merits of the claims and counter-claims of the parties and the learned court below will proceed with the appeal in accordance with law and dispose of the same independently on its own merits.

It is made clear that the time limit should be adhered to by the learned court below and no unnecessary adjournments should be given to either of the parties. The petitioners are directed to serve a copy of this revisional application along with a server copy of this order upon the opposite party and/or the learned advocate appearing in the learned court below within this week. The revisional application is disposed of.

There will be, however, no order as to costs. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
