Heard learned counsels for the parties.
The petitioners are in custody for more than 8 months. Fake Indian currency notes amounting to Rs.12,000/- were recovered from the first petitioner and fake Indian currency notes of Rs. 9,500/- were recovered from the second petitioner. Charge-sheet has been submitted. The fake currency notes have been seized. Charges are yet to be framed. Considering the material on record and also the fact that fake currency notes have been seized and investigation complete, this Court is of the view that further detention of the petitioners is not required. They may be released on bail.
Accordingly, the prayer for bail is allowed.
The petitioners namely Nurnabi Sk. @ Nurnabi @ Hurnabi @ Hurnabi Sk. and Kismat Sk. @ Kisu @ Kismot Sk. @ Sk. Kismot shall be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only) each, with two sureties of like
amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Kandi subject to condition that they shall not leave the jurisdiction of Khargram police station except for the purpose of appearing before the learned trial Court on every date of hearing. They shall not tamper with the evidence or intimidate the witnesses in any manner whatsoever.
In the event the petitioners fail to adhere to any of the conditions stated hereinabove, the learned trial Court shall be at liberty to cancel their bail in accordance with law without further reference to this Court.
The application for bail is disposed of.
